TERMS AND CONDITIONS OF PURCHASE
This agreement governs the general conditions of purchase of the various products and services offered on this website by ANELO COLOR GROUP, S.L. (hereinafter JORGE DE LA GARZA) with Tax ID number B21976667 and registered address at Av. President Josep Irla 24, 5ºA, Esc.2 de (25001) Lleida (SPAIN).
The CUSTOMER, upon completing the registration process and purchasing any of our products, expressly accepts and submits to the clauses specified below, as well as to the conditions of access and use of our portal and its privacy policy, accessible through the "Privacy Policy" link.
The CUSTOMER acknowledges having sufficient legal capacity to enter into a contract.
This contract is permanently accessible in the legal notices of our website.
- PRICES AND TAXES
In consideration for the product purchased, the CUSTOMER expressly agrees to pay JORGE DE LA GARZA the amounts specified at the time of purchase in the price list established on the website https://jorgedelagarzamakeup.com/ for the chosen products.
The products offered on this website are subject to Value Added Tax (VAT) which IS INCLUDED in the prices detailed for each product.
Before proceeding to payment for the product, the final purchase price will appear on screen, which will include VAT (Value Added Tax), management, packaging and shipping costs, if applicable, which will be reflected in the purchase order at the time of purchase and on the invoice.
Anything not specified in the description as included is not included.
- PURCHASE PROCEDURE
Through this website, orders may only be placed by natural persons over 14 years of age and companies.
All our products are detailed individually on the website. The procedure for making and managing the purchase is indicated on the website and only the following steps need to be followed:
a. Choose the product you wish to purchase.
b. When selecting a product, it can be added to the Shopping Cart and you can choose between continuing shopping or processing the order.
c. To process the order, you must complete a form with your personal data to formalize the purchase procedure.
d. Next, the order will be verified, where the selected items are detailed one by one and the total price is calculated.
e. Likewise, it will be necessary to indicate the billing and delivery addresses for the purchase made. It will be possible to indicate a single address for billing and delivery.
f. Once the process has been completed, it will be necessary to check a verification box beforehand to confirm reading and acceptance of the terms and conditions of sale.
g. The website will provide you with the mechanisms so that payment can be made according to the system chosen in each case.
h. Once the payment data has been entered, you must confirm the order by clicking the "Buy" button.
i. Once the "Buy" button is clicked, the order will be processed.
The CUSTOMER is informed that the photographs of products published as samples on the website may differ, not substantially, from the product delivered, as colors or shapes may be perceived differently by each consumer depending on multiple variables, such as the devices with which the products are viewed or environmental conditions such as light. However, these or other variables will never alter the characteristics of the products, which will be those described on the website and, in any case, the CUSTOMER may opt to withdraw from the purchase as indicated in these conditions.
- AVAILABILITY AND DELIVERY
The products offered by JORGE DE LA GARZA are available for distribution exclusively in mainland Spain and the Balearic Islands
Orders will be processed once payment has been correctly received.
The products offered by JORGE DE LA GARZA will always be subject to availability, which will be specifically indicated on our Website for each product, so that, if any offered item is not available, the customer will be duly informed of the lack of availability for purchase. Under normal conditions, all products appearing on our Website are available for delivery within the indicated timeframes.
In cases where, once the order has been placed, the product contracted by the CUSTOMER is sold out, they will be duly informed and will be offered an alternative product with similar characteristics of equal price and quality to the purchased one. If, even so, the CUSTOMER is not interested in accepting the proposed alternative, JORGE DE LA GARZA will proceed to refund the amount already paid and will inform them of the refund procedures and timeframes.
As a general rule, when using the Post Office as the delivery method, the home delivery period will be 2 to 4 days from the time of purchase and from the moment we have confirmed your payment. These delivery times are approximate and may vary depending on the destination (outside the Peninsula) or according to specific dates (for example, Christmas or "Sales" periods).
Deliveries will be made on working days (Monday to Friday). It is recommended that the CUSTOMER communicate their time preferences for delivery when completing the order data in the section for Comments.
Home delivery of the purchased product will be made by the carrier together with a delivery note at the address indicated in the purchase order, which the customer must sign as proof of receipt. Likewise, the CUSTOMER will be duly informed in the event of an incident or if the delivery is delayed for any reason.
If delivery is not possible at the address indicated due to the recipient's absence, the carrier will contact the CUSTOMER directly, and they will be given detailed instructions on the steps to follow. In the event that the impossibility of delivery is caused by an incorrect address having been provided, the cost of re-shipping the order will be borne by the CUSTOMER.
In order to keep you informed at all times of the management of your purchase, you will receive an email notification confirming your order and payment.
Likewise, the CUSTOMER can check the status of their order by sending an email to pedidos@jorgedelagarza.net.
- PAYMENT AND PAYMENT PERIODS
Credit and Debit Cards are accepted through the following payment methods:

The transaction is carried out by connecting directly with the chosen entity through its payment gateway.
Once payment has been made, you will receive an email confirmation.
JORGE DE LA GARZA has no knowledge of data relating to your credit card. All our payment systems are completely secure.
Payments are prior to delivery of the product or provision of the service, so JORGE DE LA GARZA will not provide the requested product until it has received payment for it. JORGE DE LA GARZA reserves the right to temporarily or permanently cancel the services provided in the event of any incident regarding payment collection.
- INVOICES
Upon making the corresponding payment, you will receive the Invoice for your purchase in PDF format by email if you have expressly indicated so when processing the order.
If you wish to obtain an invoice later or in the name of your company, you must contact customer service (pedidos@jorgedelagarza.net).
The CUSTOMER is responsible for confirming receipt of notifications and for informing us of any changes to their data, with JORGE DE LA GARZA being exempted from any liability arising from this circumstance.
- WARRANTY
All our products are subject to quality controls and are guaranteed against production defects for a period of 3 years from the date of purchase. The warranty covers any manufacturing, design or material defect, although it will be necessary for the lack of conformity to be manifested within 14 days of becoming aware of it. The warranty covers only defective products. It does not cover impacts, improper use, or others that are not attributable to a supplier defect or a flaw in the product.
During the warranty period, the CUSTOMER may return the product and we will proceed with its repair or replacement. Transport costs generated by returns under warranty will NOT be borne by the CUSTOMER.
The warranty document is the purchase invoice.
- RETURNS
The following conditions for returning our products do not apply in the case of exercising the right of withdrawal.
Returns or exchanges of products will only be accepted in case of factory defect, damage in transport or delivery errors. In any case, no more than 14 days must have elapsed since receipt of the product and the packaging and accessories must be included.
If it is not possible to include all accessories or original packaging, the CUSTOMER will be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.
Prior to acceptance, it will be verified that it is a manufacturing or packaging defect or anomaly and not improper or negligent use, handling or storage. They will always be accompanied by the corresponding delivery note or invoice.
Both in the case of return due to transport or packaging defect and in the case of error in the order, the CUSTOMER will be offered, if possible, the repair of the item or its replacement at no additional cost and without entitlement, on the part of the CUSTOMER, to any type of compensation. The costs generated by shipping the repaired or correct order will be borne by JORGE DE LA GARZA.
In any case, the return will always be subject to prior examination by JORGE DE LA GARZA of the condition of the product subject to return and verification that the requirements demanded in these conditions of sale have been met. Once the return has been received and if applicable, we will refund the amount collected within a maximum period of 30 days and under the same terms used to make the payment.
JORGE DE LA GARZA reserves the right to reject returns communicated or sent outside the established period or of products that are not in the same conditions in which they were received.
Returns will be managed by sending an email to pedidos@jorgedelagarza.net providing a description of the reasons and causes alleged for the return. Likewise, it will be necessary to indicate the name and surnames and the order reference number. Once the request has been received, we will process it accordingly.
- RIGHT OF WITHDRAWAL
Given the nature of some products offered by JORGE DE LA GARZA, and in accordance with article 103 points d and e of Royal Legislative Decree 1/2007, of November 16, on Consumer and User Protection, the right of withdrawal is not applicable to this contract for products with the following characteristics:
· Goods that may deteriorate or expire quickly (perishable products).
· Sealed goods that are not suitable for return for reasons of health or hygiene protection and that have been unsealed after delivery (sealed cosmetic products, for example).
The right of withdrawal will only be applicable to the purchase of products that do not contain the characteristics described above.
You have the right to withdraw from this contract within 14 calendar days without giving any reason.
The withdrawal period will expire 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the goods.
To exercise the right of withdrawal, you must notify us at ANELO COLOR GROUP, S.L. Av. President Josep Irla 24, 5ºA, Esc.2, 25001 Lleida, email: pedidos@jorgedelagarza.net, of your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail, fax or email). You may use the withdrawal form template shown below, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient that the communication relating to your exercise of this right is sent before the corresponding period expires.
Consequences of withdrawal:
In case of withdrawal on your part, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method we offer) without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.
The CUSTOMER will bear the direct costs of returning the goods, so the collection cost will be deducted from the refund, except in the case where the reason is defective quality, shipping error on our part.
We will proceed to make said refund using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any expenses as a consequence of the refund.
We may withhold the refund until we have received the goods, or until you have presented proof of the return thereof, whichever condition is met first.
Once notification of the withdrawal request has been given, you must return or deliver the goods to us directly without undue delay and, in any case, no later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract. The deadline will be considered met if you return the goods before that period has concluded.
The goods subject to return must be in perfect condition, not have been damaged, show deformations, or show signs of wear, scratches or stains. You will be responsible for any decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.
- CONTRACT PERFECTION AND SERVICE MODIFICATIONS
This contract will be perfected upon payment for the product.
JORGE DE LA GARZA reserves the right to modify in any way the characteristics and conditions of its services, always with the objective of improving them and providing a benefit to the CUSTOMER.
- OBLIGATIONS OF THE PARTIES
JORGE DE LA GARZA undertakes to provide the CUSTOMER with the products and services that have been contracted, applying maximum diligence in the provision of the service, as well as to take care of the maintenance of the facilities necessary for the operation of the network, having for this purpose adequate technical and computer equipment, and to manage the logistics, shipping and delivery operations of the purchase made through the carrier.
The CUSTOMER undertakes to use the services made available to them in good faith, without violating current laws in any matter or infringing the rights of third parties, as well as to pay for the selected product at the time and in the manner established in these conditions of sale and to receive it at the place indicated for delivery.
JORGE DE LA GARZA does not guarantee that the availability of the service subject to this contract will be continuous and uninterrupted, due to circumstances originating from problems in the Internet network, failures in computer devices and other unforeseeable circumstances. Therefore, the CUSTOMER agrees to bear these circumstances within reasonable limits.
- COMMUNICATIONS
All notifications between the parties will preferably be made via email. The CUSTOMER is responsible for confirming receipt of notifications and for informing JORGE DE LA GARZA of any changes to their data, with JORGE DE LA GARZA being exempted from any liability arising from this circumstance. In case of modification, the CUSTOMER must inform JORGE DE LA GARZA at the email or telephone numbers indicated on our website.
In compliance with article 21 of Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that our commercial mailings and information relating to our website and the products offered on it will be made by email to the email address you provide us, always on a revocable basis. In any case, you have the option to reject our commercial communications by sending an email to the address info@jorgedelagarza.net indicating the word UNSUBSCRIBE in the subject line.
- COMMITMENT, ACCEPTANCE AND VALIDITY OF THE CONTRACT
The CUSTOMER acknowledges having read and accepted the legal conditions of use and the privacy policy of the website.
The CUSTOMER acknowledges that they have understood all information regarding the products and services, including, where applicable, delivery, offered on our website, as well as all the conditions and stipulations contained in this electronic contract, and therefore affirms that they are sufficient for the exclusion of error in the consent to this contract, and therefore accepts them fully and expressly.
The CUSTOMER is fully aware that the acceptance and execution of this contract will take place through the provision of their data and clicking the "Buy" button indicated on our website and that it will be perfected upon payment for the service.
- APPLICABLE REGULATIONS
This contract is commercial in nature and will be governed and interpreted in accordance with Spanish laws.
In the event that any type of discrepancy or difference occurs between the parties in relation to the interpretation, content or execution of the Contract that is not resolved by mutual agreement, the Parties will submit to the courts or tribunals of the place of domicile of the CUSTOMER, provided that they act as a consumer.
In the event that the user has their domicile outside a Member State of the EU, or that the management consists of a sale/contract made by a company or professional, both parties submit, with express waiver of any other jurisdiction that may correspond to them, to the Courts and Tribunals of Lleida (Spain).
